The short version
Cornish Reps is a free app that counts your reps using the motion sensors in your AirPods. It is in beta. It can miscount, it can crash, and it can change or disappear at any time.
It is not a medical device and it gives no medical advice. You train at your own risk.
Your workouts stay on your iPhone. Nothing goes from the app to me. The one thing that does report back is TestFlight itself, because that part is Apple's, and it shows me crashes and any feedback you send through it.
By installing or using the app you accept these terms. If you do not accept them, do not use the app and delete it.
Who this agreement is between
This is an agreement between you and me, the developer of Cornish Reps. I am a private individual, not a company. In this text "I" and "me" mean the developer, "you" means the person using the app, and "the app" means Cornish Reps, including its updates and beta builds.
Apple is not a party to this agreement. Apple did not write the app, does not support it, and is not responsible for it. I am. Apple does require a few specific clauses in every App Store licence, and those are collected in the section "Terms Apple requires" below.
You also have to follow Apple's own rules for the App Store and TestFlight, including the Apple Media Services Terms and Conditions.
What the app does
Cornish Reps runs on iPhone with iOS 18 or newer. It counts reps of strength exercises by reading the motion sensors in Apple AirPods and compatible Beats headphones (CMHeadphoneMotionManager). The headphones have to be connected and in your ears, otherwise there is nothing to count with.
Exercises: pushups, knee pushups, abs, squats, pullups, assisted pullups, and the plank, which is timed instead of counted.
It also runs the hundred pushups program: six weeks, three workouts a week, the plan column picked from your max test, retests after the second and the fourth week, and a final test.
It counts out loud in your ear and understands four voice commands: start, stop, plus N and minus N. Speech recognition normally runs on the iPhone itself, and iOS falls back to Apple's recognition service when the on-device model is missing or keeps failing.
That is the whole app. It does not sync between devices, it does not write to Apple Health, it does not talk to any watch, and it does not send you reminders.
Free, and in beta
The app is free. There are no in-app purchases and no subscriptions, and there is nothing to buy inside it.
Right now it is handed out as a beta through TestFlight, so Apple's TestFlight rules apply to you as well, including the part where beta builds expire and stop launching.
Beta means unfinished. The app may crash, freeze, drain the battery, lose your history, show the wrong number, count nothing at all, or count movements that were never reps. Features may change or disappear between builds.
The count is an estimate worked out from the motion of your head. Treat it as a useful number, not as a measurement you can lean on for anything that matters.
I may end the beta, change the app, or never release it publicly.
Not a medical device, not medical advice
Cornish Reps is a fitness app, not a medical device. It does not diagnose, treat, cure or prevent any illness or condition, and it does not monitor your health. Nothing in the app, including the training program and the numbers it puts in front of you, is medical advice.
The hundred pushups program is a generic plan built on a well known training scheme. It sets targets from one test result and a calendar. It knows nothing about you, your health, your injuries or your limits.
Talk to a doctor before you start training, especially if you have heart, blood pressure, joint or back problems, if you are pregnant, if you are recovering from an injury or surgery, or if you have not trained for a long time. Stop at once if you feel pain, dizziness, shortness of breath or anything else that feels wrong, and get medical help.
You train at your own risk. Your technique, your warm up, your surroundings, your equipment and knowing when to stop are all on you. Do not use voice control while driving, or anywhere being distracted is dangerous.
The app is meant for adults. If you are a minor, use it only with a parent or guardian who accepts these terms on your behalf.
Your data stays on your device
There is no account, no server, no login. The app keeps everything in a single json file inside its own sandbox on your iPhone: your workouts, your test results, your settings. None of that leaves the phone, and there is no way for me to read it.
There are no ads and no analytics inside the app, and the app sends nothing to me on its own.
TestFlight is the exception, and it belongs to Apple, not to me. While the app is in beta, Apple passes me crash reports and basic install and usage numbers, plus anything you choose to send through the TestFlight feedback button, including screenshots. That happens in Apple's system under Apple's terms, and it does not include your workout file.
If you delete the app, the data goes with it. Copies may still sit in your own iPhone or iCloud backups, which belong to you and are covered by Apple's terms, not mine.
The app can export a csv of the raw sensor recording so you can email it to me and help me tune the rep detector. The file holds sensor numbers and timestamps, not audio. Sending it is entirely your choice and it only happens if you do it yourself. I use what you send only to improve detection, and you should not send me anything you would not want me to see.
The website cornishreps.com uses Yandex Metrica. That is the website. There is nothing of the sort in the app.
Permissions the app asks for
Motion and fitness, to read the headphone motion sensors and count reps.
Microphone and speech recognition, so you can say start, stop, plus N and minus N. Recognition normally runs on the device, with a fallback to Apple's service described in the privacy policy.
That is the entire list. The app sends no notifications, does not use HealthKit, and never asks for contacts, photos, health data or location.
You can refuse or withdraw any of this in iOS Settings. Without motion access the app cannot count. Without the microphone you lose the voice commands and nothing else.
Your licence to use the app
I grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for your own personal, non-commercial purposes. The licence covers Apple branded products that you own or control, and it is subject to the Usage Rules of the Apple Media Services Terms and Conditions.
You may not distribute the app or put it on a network where several devices could use it at once. You may not transfer, redistribute, sublicense, rent, lease or sell it, and you may not pass your TestFlight invitation around in ways Apple's rules do not allow.
You may not copy, modify, translate, reverse engineer, decompile or disassemble the app, or try to extract its source code, except where the law gives you that right whatever an agreement says.
The app, its name, its code, its design and its texts are mine. Any right not granted here stays with me. Your workouts and any file you export are yours.
Use the app legally and sensibly. Do not break the law with it, do not attack the app or the devices it runs on, and do not present its numbers as anything official or medically meaningful.
Support and updates
Support is me and my inbox. Write to hi@cornishreps.com and I answer when I can.
I do not promise response times, fixes, new features, updates, or that the app will keep working with future versions of iOS, future iPhones or future headphones.
Apple has no obligation whatsoever to provide any maintenance or support services for the app.
No warranty
The app is provided as is and as available, with all faults and without warranty of any kind.
To the maximum extent the law allows, I disclaim all warranties, express or implied, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy and non-infringement. I do not warrant that the app will run without interruption or errors, that it will count correctly, that it will suit your goals, or that any defect will ever be fixed.
Some countries do not allow exclusions like these. If you live in one of them, the warranties your law gives you still stand, and nothing here takes away your mandatory consumer rights.
Limitation of liability
To the maximum extent the law allows, I am not liable for injury, harm to your health, damage to property, lost or wrong data, lost time, lost progress, or any indirect, incidental, special, punitive or consequential loss arising out of the app or your use of it, even if I knew such damage was possible.
The app is free. If I am held liable anyway, my total liability to you is capped at what you paid for the app, which is nothing, unless the law sets a higher minimum.
Nothing here excludes liability that cannot be excluded by law, such as liability for death or personal injury caused by my negligence, or for fraud.
Changes, and the end of the app
I may change the app, add or remove features, break things, end the beta, or stop the app entirely, at any time and without notice.
I may also change these terms. The current version always lives at https://cornishreps.com/terms/ with the date at the top. Keep using the app after a change and you accept the new version. If you do not agree with it, stop using the app and delete it.
The licence runs until it ends, and it ends automatically if you break these terms, or when you delete the app. You can delete the app at any moment, for any reason or none. The sections on warranty, liability, Apple and governing law outlive the rest of this agreement.
Terms Apple requires
Acknowledgement. This agreement is between you and me only, and not with Apple. I, and not Apple, am solely responsible for the app and its content. This agreement does not conflict with the Apple Media Services Terms and Conditions, and it is your responsibility to comply with those terms.
Scope of licence. The licence granted to you is non-transferable and limited to using the app on any Apple branded products that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where Apple allows it.
Maintenance and support. I am solely responsible for providing any maintenance and support services for the app, at hi@cornishreps.com. Apple has no obligation whatsoever to furnish any maintenance and support services for the app.
Warranty. I am solely responsible for any product warranties, express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. The app is free, so that refund is zero. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are my sole responsibility.
Product claims. I, and not Apple, am responsible for addressing any claim from you or from a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to meet a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar law. This app uses neither HealthKit nor HomeKit.
Intellectual property. If a third party claims that the app or your possession and use of it infringes that party's intellectual property rights, I, and not Apple, am solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with any applicable export laws when you use the app.
Third party terms. You must comply with any applicable third party terms when you use the app, including the terms of your mobile data plan and Apple's terms for TestFlight and the App Store.
Third party beneficiary. Apple and Apple's subsidiaries are third party beneficiaries of this agreement. Once you accept these terms, Apple has the right, and is deemed to have accepted the right, to enforce this agreement against you as a third party beneficiary of it.
Developer contact. Questions, complaints and claims about the app go to hi@cornishreps.com. I am a private individual, and I will give my full name and postal address to anyone with a legal reason to need them.
Governing law
These terms are governed by the law of the country where I live, and any dispute about them belongs to the courts of that country. Ask at hi@cornishreps.com and I will tell you which country that is. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you are a consumer, none of that takes away the protection of the mandatory consumer law of the country where you live, or your right to go to your local courts where the law gives you that right.
If some part of these terms turns out to be unenforceable, the rest stays in force.
The whole agreement
These terms, together with Apple's own terms for the App Store and TestFlight, are the whole agreement between you and me about the app, and they replace anything I said about it earlier.
If I do not enforce a part of these terms straight away, that does not mean I have given it up.
